1. Scope of Application

These General Terms and Conditions apply to all contracts concluded between us and our customers through the online shop, unless otherwise agreed or mandatory legal provisions apply.

2. Contracting Party

The purchase contract is concluded with:

Eliene Costa
Am Wäldle 1
79801 Hohentengen

3. Customer Service Hours

You can contact customer service for complaints, claims, questions, and information:

Monday to Friday, from 8:00 a.m. to 11:00 p.m.

Phone: +49 (0) 7742 9789544
Email: info@mondocasa.de

4. Conclusion of the Contract

In our online shop, you can select individual products or compositions and contact us by phone or email. We will then clarify together all details of the order (model, dimensions, finishes, possible customizations, production times, and delivery times).

Particularly for kitchens, within a radius of approximately 200 km from our company headquarters, we personally carry out an on-site measurement and consultation appointment.

You will then receive a written order confirmation containing a complete summary of the delivery and sales conditions. This constitutes an offer to conclude the purchase contract. You may accept this offer by email.

5. Prices and Shipping Costs

Prices are specified in the order confirmation. VAT is shown separately.

Upon conclusion of the purchase contract, an amount equal to 50% of the sale price becomes immediately due. Production or ordering from the manufacturer will only begin once this payment has been received.

The remaining 50% of the invoice amount is due upon delivery of the goods according to the agreed payment terms.

6. Payment Methods

The available payment methods are specified in the order confirmation.

7. Delivery and Delivery Conditions

Delivery is made by shipment to the delivery address specified by the customer.

Delivery times are indicated in the order confirmation.

For deliveries outside the European Union, additional customs duties and taxes may apply. These must be paid directly to the competent customs or tax authorities. Please check with the relevant authorities before placing an order.

8. Assembly Service

Within a limited radius from our headquarters, we provide assembly services directly ourselves. Outside this radius, we can arrange the service through external partners upon request.

Prices depend on the scope of the order.

9. Transport Damage

If an item is delivered with obvious transport damage, please report it immediately to the carrier and inform us without delay.

To facilitate proof of the damage, you may also take photographs of the damaged packaging or goods.

Failure to report transport damage has no effect whatsoever on your statutory warranty rights; it merely helps us assert possible claims against the transport company.

10. Storage of Contract Text

We store the order data and the contract text.

Our Terms and Conditions can be viewed at any time on this page.

Together with the order confirmation, you will receive by email the order details, the Terms and Conditions, the cancellation policy, and the cancellation form.

11. Warranty / Manufacturer’s Guarantee

Warranty is provided in accordance with statutory provisions.

We do not provide our own guarantees for products. Manufacturers generally provide guarantees on their products, usually valid for 24 months.

Details can be found in the manufacturer’s warranty conditions enclosed with the delivered goods.

Your statutory warranty rights against us are not limited by the manufacturer’s guarantee. Therefore, in the event of defects, you may contact us at any time under the applicable statutory warranty provisions regardless of any manufacturer’s guarantee.

For used goods, the warranty period is one year from delivery of the goods.

The reduced warranty period does not apply to damages resulting from injury to life, body, or health caused by our fault, nor to other damages resulting from intentional misconduct or gross negligence.

12. Liability

We are fully liable for damages resulting from injury to life, body, and/or health.

We are also liable in cases of intent or gross negligence, fraudulent concealment of a defect, or in all other cases regulated by law.

In the event of a breach of an essential contractual obligation, liability for slight negligence is limited to foreseeable damages typical of the contract.

(A contractual obligation is considered essential if its breach causes such a significant disadvantage to the affected party that the party is substantially deprived of what it could reasonably have expected from the contract.)

In the event of a breach of non-essential contractual obligations, liability is limited to intent and gross negligence.

13. Final Provisions

The law of the Federal Republic of Germany shall apply.

The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply.

For consumers, this choice of law shall apply only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

The contract language is German.

Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall replace the invalid provision.
